Terms and Conditions for Tutors – Consent on Collection, Use & Disclosure of Personal Data

By registering as a tutor with Lernscape, you hereby agree to the collection, usage, and disclosure of your personal data by our organization for the following purposes, in accordance with the Personal Data Protection Act 2012:

(a) Receiving available tuition assignments through various communication modes (including, but not limited to, WhatsApp, SMS, Telegram, Email). (b) Sharing your information with the respective client upon confirmation of a tuition lesson. (c) Receiving tutor-related marketing messages via email or messaging platforms (including, but not limited to, WhatsApp, SMS, Telegram, Email).

Acceptance of Terms and Conditions

By registering as a tutor with Lernscape or accepting a tuition assignment from Lernscape, you acknowledge and accept the following Terms and Conditions pertaining to the tuition matching service provided. The engagement will be formalized upon the receipt of a Confirmation Note through WhatsApp/SMS/Email or upon conducting the first tuition lesson as arranged with the client.

Registration

All tutors registering with MindFlex must be a minimum of 16 years old and possess a GCE “O” Levels certificate or an equivalent academic qualification.

Qualifications and Authentication of Documents

All tutors are required to provide accurate information regarding their academic certifications and personal details. Clients reserve the right to request verification of these certifications at any time. Tutors found attempting to deceive clients with fake qualifications and certifications will be reported to the authorities.

General Guidelines for Lesson Conduct

Tutors are expected to conduct themselves in a professional and ethical manner during tuition lessons. Unsatisfactory conduct may result in the termination of current and future assignments. The following are general guidelines for tuition lessons:

  1. Provide at least 48 hours’ notice for any change of timing. In the case of sudden sickness, a medical certificate (MC) may be requested from the parent.
  2. Punctuality is expected, and tutors should not shorten the duration of tuition lessons.
  3. Physical or verbal abuse towards students or parents will not be tolerated under any circumstances.
  4. Tutors are expected to maintain regular communication with parents regarding the student’s progress.


Commitment to Tutoring Period

Unless otherwise stated, tutors are expected to commit to an assignment for at least 3 months. If you are unable to fulfil this commitment due to special reasons or circumstances, you must inform Lernscape to prevent misunderstandings and potential blacklisting for future assignments.

After the first conducted lesson, tutors are responsible for making arrangements directly with the client for subsequent lessons. Any personal, payment, or cancellation terms should be clearly communicated to the client after the first lesson.

Commission and Payment of Tutor Fees

Upon successful confirmation of each tuition assignment, a confirmation note and invoice will be sent. Clients are required to make payment for the first 2 weeks of lessons to Lernscape upon completing these 2 weeks. Subsequent payments may be made directly to the tutor. In cases where the client is unable or unwilling to transfer the 50% commission to Lernscape, the tutor will be required to collect it on our behalf and transfer it to Lernscape at the earliest opportunity.

Commission Amount

Lernscape collects a one-time commission equivalent to its tutors’ first 2 weeks of lessons. This commission is collected directly from the client, and no further action is required from the tutor. If any additional tuition services are added during the first month (e.g., tuition for siblings or additional subjects), this information must be communicated to MindFlex and will also be subject to commission.

Tutor Cancellation

Clients have the right to request a change of tutor at any time. In such scenarios, if the tuition is cancelled or changed within the first 4 weeks of lessons by the client, Lernscape will only collect 50% of the tuition fees involved. The remaining 50% will be paid directly to the tutor.

Tutors may not be entitled to their share of 50% of the fees in certain cases, including, but not limited to:

  1. Cancellation of the assignment from the tutor’s end.
  2. Failure to carry out the tuition lesson to a reasonable standard.
  3. Providing false or inaccurate information in the tutoring profile.
  4. Inability to provide supporting documents for the information listed in the tutoring profile (e.g., Academic Certificates).

Lernscape will thoroughly review the facts and circumstances of each case, considering the interests of all parties involved. As the coordinating agency, Lernscape reserves the right to make the final decision on the outcome of the case at hand.

Tuition Rates

The agreed-upon tuition rates should not be changed after lesson confirmation. However, if the tutor decides to increase the tuition rate subsequently, for instance, due to the student’s academic level advancement, it may be done with proper communication.

Length of Commitment, Postponement of Lessons, and Last-Minute Cancellations

Once confirmation is received from the tutor via any communication form (SMS, WhatsApp, Email, Phone call), the tutor is expected to complete at least 4 weeks of lessons. Irresponsible behaviour may result in blacklisting for future tuition assignments.

If a postponement is necessary, the tutor must inform the client at least 2 days in advance. In case of sudden sickness, an MC may be required to be provided to the client.

Tutors may reschedule lessons only with mutual agreement from the client.

For last-minute cancellations of the first arranged lesson, if the client cancels less than 2 hours before the designated tuition timing, the client will be liable to pay 50% of the pre-agreed lesson fees as compensation for the tutor’s time & transport cost.

For last-minute cancellations of the second arranged lesson and beyond, the tutor must communicate their personal cancellation policies beforehand and seek any recourse directly with the client. This will not be within the agency’s purview.

Location of Lessons

The tuition lessons shall take place at the specified address mentioned in the assignment.

Collusion & Fraud

Any attempts to avoid paying the commission due to Lernscape (in any form) are considered illegal and unethical actions. Our company strictly does not tolerate such fraudulent behaviour. Immediate police reporting and civil actions will be pursued to recover lost monies resulting from fraudulent actions.

Disclaimer

Lernscape reserves the right to amend the Terms and Conditions at any time without prior notice.
